Unit 1: Driver Licenses & the Learner Permit

Types of Non-Commercial Licenses

New York State recognizes six types of non-commercial driver licenses, each with its own minimum age.

  • Operator, Class D — minimum age 18, or 17 with a driver education Certificate of Completion. Allows driving a vehicle with a GVWR of 26,000 lbs or less.
  • Junior Operator, Class DJ — minimum age 16. Allows driving a vehicle with a GVWR of 10,000 lbs or less. Subject to Junior Operator Restrictions (where/when/with whom you can drive).
  • Motorcycle, Class M — minimum age 18, or 17 with a driver education Certificate of Completion.
  • Junior Motorcycle, Class MJ — minimum age 16. Also subject to Junior Operator Restrictions.
  • Taxi/Livery, Class E — minimum age 18. Allows transporting passengers for hire.
  • Enhanced Driver License (EDL) — usable for land/sea border crossings instead of a passport; available to NYS residents who are U.S. citizens.

The Written (Knowledge) Test

To pass the written test for a Class D, M, DJ, MJ or E license, you must correctly answer at least 14 of the 20 questions asked — but you must also correctly answer at least 2 of the 4 questions about road signs specifically. To pass the vision test, you need 20/40 vision in at least one eye, with or without corrective lenses.

Students who are at least 15 years and 11 months old can take the written test early through the DMV Online Knowledge Test Application (OKTA) program, offered at participating high schools. Students who pass online receive a receipt and can apply for a learner permit once they turn 16.

  • Pass threshold: 14 of 20 questions correct
  • You must also get at least 2 of the 4 road-sign questions correct
  • Vision requirement: 20/40 in at least one eye
  • OKTA online testing is available starting at age 15 years, 11 months

Supervised Driving with a Learner Permit

Once you pass the vision and written tests and pay your fees, your learner permit is issued and you can start to practice. Whenever you practice, you must be supervised by a licensed driver who is at least 21 years old, holds a license valid for the vehicle you are driving, and sits in the front seat with you.

If you hold a Junior (DJ) permit, the ONLY passenger allowed in the front seat is your supervising driver. You also cannot drive with more than one passenger under age 21 unless they are members of your immediate family, or your supervising driver is your parent, guardian, person "in loco parentis," driver education teacher, or driving school instructor.

  • Supervising driver must be 21+, properly licensed, and in the front seat
  • Junior permit holders: only the supervising driver may sit in the front seat
  • Every passenger must wear a seat belt — one per person
  • You cannot practice in a DMV road test area or on certain restricted parkways/bridges/tunnels

Regional Restrictions for a Junior Permit

Graduated Driver Licensing (GDL) laws restrict when and where a Junior (DJ) Permit holder may drive, and who may supervise, based on region.

  • All regions: driving hours are 5 AM – 9 PM. You must NOT drive from 9 PM – 5 AM in New York City or Long Island.
  • Upstate (all other counties): 9 PM–5 AM driving is allowed only under immediate supervision of a parent, guardian, person in loco parentis, driver ed teacher, or driving school instructor (all age 21+, properly licensed).
  • NYC and Long Island (5 AM–9 PM): supervising person must be a parent, guardian, person in loco parentis, driver ed teacher, or driving school instructor (Long Island also allows a person designated in writing by the parent/guardian).
  • NYC additionally requires the vehicle have dual controls (dual brakes) during supervised practice.

Preparing for and Taking the Road Test

Before taking the road test, it is recommended you have at least 50 hours of practice, including at least 15 hours after sunset, with at least 10 hours in moderate-to-heavy traffic. A Junior Permit must be held for a minimum of six months (excluding suspension/revocation time) before a road test can be scheduled.

You must complete an approved Safe Driving Course (fulfilled automatically by a high school/college driver education course, or via a special Pre-Licensing course). At the road test, you must bring your photo learner permit, your Pre-Licensing Course Completion Certificate (or have one on file), and a correctly registered, inspected, insured vehicle in good working order — including a clean, available passenger-side seat belt for the examiner. You must also bring a supervising driver (21+, properly licensed) if you drove yourself to the test.

  • Recommended: 50 hours of practice, 15+ after sunset, 10+ in moderate-to-heavy traffic
  • Junior Permit must be held 6 months minimum before scheduling a road test
  • Safe Driving Course / 5-hour Pre-Licensing Course is required
  • The road test takes about 15 minutes and covers turns, intersections, and backing to the curb

Junior Operator Restrictions (After You Have Your License)

These restrictions continue after you pass the road test and receive a Junior (DJ) License, until you turn 18 or upgrade to a senior license.

  • NYC (5 AM–9 PM and 9 PM–5 AM): you must NOT drive at all, with very limited exceptions.
  • Long Island (5 AM–9 PM and 9 PM–5 AM): you may drive alone only directly between home and employment, a work-study program, a college/university/evening high school course, a driver education course, or farm employment — or when accompanied by your licensed parent, guardian, person in loco parentis, driver ed teacher, or driving school instructor.
  • Upstate (5 AM–9 PM): you may drive without being accompanied. (9 PM–5 AM): you may drive alone only directly between home and employment or a school course; all other driving must be accompanied.
  • You cannot drive with more than one passenger under age 21 unless they are immediate family.

License Renewal

You are responsible for knowing when your license expires and renewing it on time, even if you never receive a reminder notice. If DMV has your current address, you should receive a renewal notice about 45 days before expiration. You can renew up to one year before the printed expiration date.
